Welcome to Wellmynt. These Terms & Conditions (“Terms”) govern your access to and use of Wellmynt’s websites, assessments, wellness coaching services, communications, reports, subscriptions, and related products and services (collectively, the “Services”).

By accessing or using the Services, creating an account, completing an assessment, or purchasing a Wellmynt subscription, you agree to these Terms. If you do not agree, please do not use the Services.

1. About Wellmynt

Wellmynt provides wellness coaching, educational information, personalized wellness insights, and tools designed to help individuals better understand their everyday habits and work toward personal wellness goals.

Depending on the Services you use, Wellmynt may provide features such as:

Wellness assessments and Wellness Scores

Personalized Wellmynt Snapshots

Personalized Wellness Blueprints

Wellness coaching and support

Regular check-ins

Progress updates and updated Wellness Scores

Educational wellness information

Other wellness-related tools and communications

Features may be added, modified, or discontinued over time.

2. Not Medical Care

Wellmynt is a wellness coaching and educational service. Wellmynt does not provide medical advice, medical diagnosis, medical treatment, psychotherapy, or other licensed healthcare services.

Wellmynt is not a doctor, healthcare provider, therapist, dietitian, or other licensed medical professional, and use of the Services does not create a doctor-patient or other healthcare-provider relationship.

Information provided through Wellmynt should not be used as a substitute for advice from a qualified healthcare professional.

You should consult an appropriate healthcare professional regarding medical conditions, symptoms, medications, treatments, dietary restrictions, exercise limitations, mental health concerns, or other healthcare decisions.

3. Emergencies

Wellmynt is not an emergency or crisis service and should not be relied upon in an emergency.

If you believe you are experiencing a medical emergency or an immediate threat to your health or safety, contact your local emergency services or seek appropriate professional assistance immediately.

Do not delay seeking professional care because of information provided through Wellmynt.

4. Wellness Assessments and Scores

Wellmynt may provide assessments, Wellness Scores, Snapshots, progress updates, and other personalized insights based on information you provide.

These tools are intended for general wellness and educational purposes only. They are not medical assessments, clinical evaluations, diagnostic tests, or predictions of your future health.

Wellness Scores and related insights are based on Wellmynt's methodology and the information available to the Services. They may not account for every factor affecting your health or wellbeing.

Scores may change over time as new information becomes available, your habits change, or Wellmynt's methodologies and Services evolve.

5. Wellness Coaching

Wellmynt coaching may provide general wellness guidance relating to topics such as movement, sleep habits, nutrition, stress management, lifestyle habits, consistency, motivation, and personal wellness goals.

Coaching is intended to support general wellness and behavior change. It is not individualized medical treatment.

You are responsible for determining whether recommendations are appropriate for your individual circumstances and for consulting qualified professionals when appropriate.

6. Artificial Intelligence and Automated Technology

Wellmynt uses artificial intelligence, automation, and other technology to help provide personalized assessments, insights, wellness plans, coaching, progress updates, communications, and other Services.

AI-generated information may occasionally be inaccurate, incomplete, inconsistent, or inappropriate for your individual circumstances.

You should use reasonable judgment when relying on information provided through the Services and seek professional guidance when appropriate, particularly for matters involving your health or safety.

Wellmynt does not guarantee that AI-generated or automated content will always be accurate, complete, or suitable for you.

7. Information You Provide

The quality and relevance of Wellmynt's personalized Services depend substantially on the information you provide.

You agree to provide information that is accurate and complete to the best of your knowledge.

Wellmynt is not responsible for inaccurate or inappropriate results caused by incomplete, inaccurate, outdated, or misleading information provided by you.

You are responsible for keeping your contact and account information current.

8. Eligibility

You must be at least 18 years old to purchase or use paid Wellmynt Services unless Wellmynt expressly permits otherwise.

By using the Services, you represent that you meet the applicable eligibility requirements and have the legal capacity to enter into these Terms.

9. Communications

By providing your email address or mobile phone number, you agree that Wellmynt may communicate with you regarding your assessments, account, coaching, membership, progress, and other Services you request.

Depending on your choices and applicable law, you may also receive promotional communications from Wellmynt.

Message and data rates may apply to SMS communications depending on your mobile carrier and plan.

You may opt out of promotional email or text communications using the unsubscribe or opt-out instructions provided with those communications. Certain transactional or service-related communications may still be necessary to provide your Services.

10. Subscriptions and Billing

Certain Wellmynt Services are offered through recurring paid subscriptions.

By purchasing a subscription, you authorize Wellmynt and its payment processor to charge the payment method you provide for the amount and billing frequency disclosed to you at checkout.

Your subscription will automatically renew at the applicable recurring rate unless you cancel it in accordance with the cancellation terms presented to you.

Applicable prices, billing frequency, introductory offers, trials, or other subscription terms will be disclosed at the time of purchase.

You are responsible for maintaining a valid payment method.

11. Cancellation

You may cancel your Wellmynt subscription in accordance with the cancellation instructions provided on our website or through the cancellation method made available to you.

Unless otherwise stated at the time of purchase or required by applicable law, cancellation stops future renewals and does not retroactively refund charges that have already been processed.

After cancellation, you may continue to have access to applicable paid Services through the end of your current paid billing period.

12. Refunds

Except where otherwise stated at the time of purchase or required by applicable law, payments for Wellmynt Services are non-refundable once charged.

If you believe you were charged incorrectly, please contact Wellmynt so the matter can be reviewed.

Nothing in these Terms limits any refund or cancellation rights that cannot legally be waived.

13. No Guaranteed Results

Individual wellness outcomes vary significantly.

Wellmynt does not guarantee weight loss, improvements in health, fitness, sleep, stress, nutrition, habits, Wellness Scores, or any other particular outcome.

Results depend on numerous factors outside Wellmynt's control, including your individual circumstances, health, behavior, consistency, environment, and decisions.

Testimonials, examples, sample reports, or descriptions of potential results are illustrative and do not guarantee that you will achieve similar results.

14. Acceptable Use

You agree not to misuse the Services or interfere with their operation.

You may not:

Use the Services for unlawful, fraudulent, abusive, or harmful purposes

Attempt to gain unauthorized access to Wellmynt systems or another user's account

Interfere with or disrupt the operation or security of the Services

Use automated methods to scrape, copy, or extract substantial portions of the Services without permission

Reproduce, resell, distribute, or commercially exploit Wellmynt content or Services without authorization

Use the Services in a manner that infringes the rights of Wellmynt or others

Wellmynt may restrict or terminate access when it reasonably believes the Services are being misused.

15. Intellectual Property

The Wellmynt name, branding, website, assessment methodology, reports, designs, content, software, graphics, and other materials provided through the Services are owned by or licensed to Wellmynt and are protected by applicable intellectual property laws.

Subject to these Terms, Wellmynt grants you a limited, personal, non-exclusive, non-transferable right to use materials provided to you through the Services for your own personal, non-commercial wellness purposes.

Nothing in these Terms transfers ownership of Wellmynt intellectual property to you.

16. Third-Party Services

Wellmynt may rely on third-party providers for services such as payment processing, communications, hosting, artificial intelligence, analytics, and other technology.

Your use of certain third-party services may also be subject to those providers' terms and privacy practices.

Wellmynt is not responsible for outages, errors, or actions of third-party services beyond Wellmynt's reasonable control.

17. Service Availability and Changes

We work to provide reliable Services, but we do not guarantee that Wellmynt will always be available, uninterrupted, secure, or error-free.

Wellmynt may modify, improve, replace, suspend, or discontinue features of the Services as the product evolves.

We may also update our methodologies, assessment criteria, scoring systems, coaching features, or other functionality.

18. Privacy

Your use of Wellmynt is also subject to our Privacy Policy, which explains how we collect, use, store, and protect information.

19. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

Wellmynt makes no warranties, express or implied, regarding the accuracy, reliability, availability, completeness, merchantability, fitness for a particular purpose, or suitability of the Services for your individual circumstances.

Nothing in this section excludes warranties or rights that cannot legally be excluded.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Wellmynt and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Services.

To the fullest extent permitted by applicable law, Wellmynt's total liability for claims arising from or relating to paid Services will not exceed the amount you paid to Wellmynt for the applicable Services during the twelve months immediately preceding the event giving rise to the claim.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Wellmynt and its owners, affiliates, employees, contractors, and service providers from claims, damages, liabilities, and reasonable expenses arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of the rights of another person.

22. Termination

You may stop using Wellmynt at any time.

Wellmynt may suspend or terminate your access to the Services if you materially violate these Terms, misuse the Services, fail to pay applicable charges, or engage in conduct that threatens the security or operation of the Services or other users.

Provisions that by their nature should survive termination will remain in effect after termination.

23. Changes to These Terms

We may update these Terms from time to time as Wellmynt and applicable requirements evolve.

When changes are made, the updated Terms will be posted with a revised “Last Updated” date. Where required by law, we will provide additional notice or obtain consent before material changes take effect.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

24. Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, except where applicable consumer protection laws require otherwise.

Any disputes will be handled in accordance with applicable law.
